Often times in literature, writers use different techniques to convey their ideas. One of the most common techniques in literature is the allegory, a literary device that expresses hidden meanings through symbols, settings, and even characters. William Golding’s Lord of the Flies is a perfect example of an allegorical novel. Lord of the Flies is a novel in which several British boys are stranded on a remote island following a plane crash, and must cooperate with each other in order to survive. The reader can either choose to read Lord of the Flies from a literal perspective as an adventure story, or they can choose to read it from figurative perspective as physiological, religious, political, or social allegory. Golding successfully manages to incorporate issues of innocence, savagery, and religion through these allegories without even mentioning them specifically in the novel. The most commonly used allegory in the novel is the social allegory; Golding uses the novel’s four main characters, Ralph, Jack, Piggy, and Simon, to represent different parts of society. In Lord of the Flies, Golding uses the four main characters as social allegories; Ralph is used to represent fair/democratic government, Jack is used to represent power/dictatorship, Piggy is used to represent technology/intellect, and is used Simon to represent humanism. Ralph represents the fair/democratic government found in human society. Originating from Britain, Ralph tries to mimic the Parliament by employing his own conch-led government system. When Ralph notices that they cannot have everyone talking at once, he says, â€Å"I’ll give the conch to the next person to speak. He can hold it when he’s speaking† (45). The definition of a democracy is a system of governm... ...as to tell the boys that there was in fact no beast, it was only a dead parachutist. Rather than being read from a literal perspective, the reader can choose to read Lord of the Flies as one vast social allegory. The four main characters, Ralph, Jack, Piggy, and Simon, are used as social allegories to represent different parts of society. Ralph is used to represent democratic government, Jack is used represents autocratic government, Piggy is used to represent the intellectual part of society, and Simon is used to represent humanistic part of society. While it may be just a narrative telling of several boys marooned on an island, Golding’s plentiful use of allegories gives Lord of the Flies a much more profound meaning than just that. Without these allegorical elements, Lord of the Flies would just be a common adventure novel with no significant moral meaning.

Taylor Sakamoto AP/IB English 3 IB Paper P.6 In the novel Woman at Point Zero the author, Nawal El Saadawi, retells the life story of Firdaus, the main character, a tragic hero who rebels against the social norms within her oppressive culture seeking the same respect and prestige that is bestowed upon her male oppressors, only to be executed for her attempt to obtain the same privileges as men. This essay will demonstrate how the aspects and expectations of Egyptian culture influence Firdaus’s decisions as she struggles to be her own woman in a society controlled by dictatorial political and patriarchal structures all while exposing the evident discontentment she has with the way Egyptian society views women, and the glorification of things that go against ideal societal structures. Firdaus’s culture shapes her to become the resilient and insubordinate woman she is when she tells Saadawi her story. She starts out having a happy childhood where her mother lovingly cared for her. She describes her mother’s eyes as undefined by color nor shape but states that her mother’s eyes â€Å"were eyes that [she] watched. They were eyes that watched [her]. Even when [she] disappeared from their view, they could see [her], and follow [her] wherever [she] went, so that if [she] faltered while learning to walk, they would hold [her] up† (page 15). This fairly intimate descriptions of eyes, demonstrates how in Egyptian culture eye contact is very important as it conveys a sense of closeness as well as power; the way Firdaus’s mother watches out for her establishes that her family was indeed close knit and played a huge role early on in her life because the eyes that seem to always be present, would guide her to conform to society’s stand ards. Woman at Point Zero, written by Nawal El Saadawi, effectively rebels and defies the tyrannical administrative and male-controlled structures that are meant to oppress women in Egypt. This novel does this by telling of Firdaus’s bold life, the blatant dissatisfaction with the way her culture attempts to reduce the importance of women by objectifying them to nothing more than domestic servants, and the glorification of things that go against their customary values. Through her struggles, she becomes her own woman, and ultimately dying for her belief that she is inferior to no man in the process. This discontentment and glorification are made very evident throughout this novel as she disregards the cultural standards that Egyptian society expects her to uphold; and seem to be intertwined within Firdaus’s story on almost every single page.

Casefile Method – Answer to Casefile 1.1

MEMORANDUM 03. 01. 2010 TO: FROM: RE: Daphne Matthews Alex Associate – 4667 Memo Assignment 1: Who Does the Pastry? I. Introduction Collins was hired as Head Chef at the Marrimount Hotel and believed that this job came with the inherent authority to choose his assistant chefs, even though nothing of this was mentioned in the contract for employment. Therefore, when Crest, owner of the Marrimount, attempted to determine Collins's assistants, Collins quit his job and went to work for the Treadwell Center. The contract It may actually be good for Collins to argue that there was no contract between himself and Crest. First, there was no detailed employment agreement, just a letter signifying the contract terms. The letter referred to itself as a contract lasting for â€Å"five years from the signature thereof. † However, presumably it was never signed and therefore never consummated. Secondly, Collins could argue that this is an agreement in violation of the statute of frauds, since it requires more than one year to perform and was not signed. Therefore, if Collins argues that he never signed nor agreed to the contract terms, perhaps he can avoid, altogether, the issues of breach of fiduciary duty and the injunction against working for a competitor. However, it seems evident that both Collins and Crest considered the agreement to be a binding employment contract. This is not merely an oral agreement to be finalized at a later date, as was the case in Tropicana Hotel Corporation v. Speer. Collins demonstrated an immediate intent to be bound by the agreement by moving to New York from Atlanta and performing for a year under the contract. Therefore, since it is likely that the court will find a five-year contract existed and the contract was breached, the question becomes who is liable for the breach? III. Who breached first? The facts are undisputed that Collins left the kitchen upon the hiring of an unacceptable pastry chef. This would likely constitute a breach of Collins’s employment contract absent any other considerations. However, as the Kansas court states: â€Å"A party is not liable for a material failure of performance if it can show that the other party committed a prior material breach of the contract; in such event, the prior breach discharged the first party's own duty to perform. Therefore, if it can be shown that Marrimount breached its contract by preventing Collins from choosing his own assistant chefs, Collins can avoid Crest’s allegations of breach of fiduciary duty and the injunction against working for a competitor since Crest breached the contract first. II. a. Argument that Crest breached first i. Define â€Å"head chef† to determine duties The Supreme Court of Virginia stated in Neely v. White, â€Å"Before partial failure of perfor mance of one party will excuse the other from performing his contract or give him a right of rescission, the act failed to be performed must go to the root of the contract. Therefore, Collins must show that the overruling of his choice for pastry chef and the hiring of an unacceptable assistant chef constitutes a material breach of contract. The chief dispute is over what duties are included in a position of Head Chef. The written agreement merely states that Collins will â€Å"assume the duties of head chef,† without stating what those duties are. It might be helpful to point out that the general rule with ambiguities in a contract is that the contract will be construed against the drafter, in this case, Crest. Additionally, it is helpful that Collins states in his deposition that it is â€Å"industry standard† for a head chef to select his own assistants, much like a basketball coach selects the starting lineup, not the athletic director who hired him. Typically, â€Å"when evidence of custom and usage of the trade is used to interpret a contract and the issue is disputed, summary judgment is inappropriate†¦Ã¢â‚¬  (Nadherny v. Roseland Property Company, Inc. ). It is also helpful to our case that Mrs. Stein states in her deposition, â€Å"the head chef runs the dining room. † While not acknowledging the specific ability to hire, Mrs. Stein is definitely associating Collins’s role as more managerial than Crest is claiming he had. Further, Collins was able to hire his own dessert chef without interference, creating a presumption that the hiring of his team was within his authority. More logically, this is a big hotel that was seeking Collins out because he was known for preparing gourmet meals for large groups. A Head Chef is more than a cook. They are in charge of the dining room, carefully selecting staff that can help prepare these large meals that would not be possible to create with just one person. This was a managerial or executive position as much as it was a cooking one. Crest was not just looking for a cook when they hired Collins; they were looking for a Head Chef. By taking away Collins’s ability to hire and fire his â€Å"team† they materially breached the contract to employ Collins as the Head Chef. A court will likely find such an argument persuasive and deem that Crest materially breached the contract first. ii. Reduction in duties or rank is a breach of contract Collins will want to argue that this case is analogous to Rudman v. Cowles Communications, Inc. , which is controlling authority in New York. In Rudman, an editor was hired to manage and oversee the publication of his series of books. The employer then began changing Rudman’s books without approval and took away his managerial role and oversight. The court found a breach of contract and explained, If an employee†¦is engaged to fill a particular position, any material change in his duties, or significant reduction in rank, may constitute a breach of his employment agreement. † Here, Crest will argue that the employment agreement was far clearer in Rudman, and the employer agreed upon Rudman’s authoritative role, although not expressly in the contract. Collins will want to rebut this argument by comparing an editor to a chef and looking at industry standards. Just as the court in Rudman stated that Rudman could not â€Å"be reduced to being only a productive writer,† neither can Collins, the head chef, be reduced to being only another cook. And finally, the court states: â€Å"an independent entrepreneur like Rudman would not expect and probably would not accept a subordinate scrivener’s role. † If an editor would not accept a subordinate role as a writer, then the court will likely find that an esteemed head chef like Collins would definitely not accept a subordinate role either. iii. Crest’s rebuttal Crest will point to cases like Tropicana Hotel Corporation v. Speer in an attempt to compare Collins to Speer. Crest will argue that there was nothing in the employment agreement that gave Collins the sole right to hire assistant chefs. In Tropicana the court found that Speer was not constructively discharged and Crest will argue for the same outcome. Additionally, Crest will argue that this case is more like Handicapped Children’s Education Board of Sheboygan County v. Lukaszewski. There, a speech therapist claimed health reasons for breaching her contract and leaving one job to take on another position closer to home. The court held that the danger to Lukaszewski’s health was selfinduced and that Lukaszewski did not resign for health reasons, but to take a better job. Crest will compare Collins’s actions to Lukaszewski’s, claiming there was no breach by Crest, only a breach by Collins in walking out and taking a better position where he would have managerial authority over his assistant chefs. iv. Likely outcome It is likely that the court will find that Crest breached the employment contract with Collins by hiring an unapproved member to his team of chefs, effectively converting Collins from a top-tier chef into just another cook in the kitchen. If however, the court determines that Crest did not breach the contract, then Crest will push forward with their claim for breach of contract and breach of fiduciary duty of loyalty. b. Argument that Collins breached first i. Breach by quitting before 5-year contract terminated Crest’s first argument will be that Collins breached his contract when he quit coming into work after the Hispanic chef was hired. Nothing in the contract stated that Collins’s duties included the sole ability to hire chefs, but not coming into work is most definitely a violation of the â€Å"duties of head chef† that he did possess. Thus, if Collins can’t show that Crest breached the contract first by hiring the chef without his approval, he is in trouble. ii. Breach of fiduciary duty of loyalty In Collins’s deposition, he states that he was in discussions with the Treadwell center, but not until after Crest’s hired an assistant chef and breached the contract. Thus, if Collins cannot show that Crest breached the contract first, he is also going to have to defend a claim for breach of fiduciary duty. Crest claims that Collins convinced the Casketmaker’s Convention to leave the Marrimount and relocate to the Treadwell Center. If they can prove this, they will have a claim for breach of fiduciary duty of loyalty. In Orkin Exterminating Co. v. Rathje, the court stated, â€Å"[A]n executive employee is barred from actively competing with his employer during the tenure of his employment, even in the absence of an express covenant so providing. † iii. Collins’s Rebuttal In response to Crest’s claim that Collins breached the contract by quitting, Collins should point to Tropicana. The argument is that by breaching its contractual duty to Collins, Crest constructively discharged Collins. Unlike Tropicana, in which the plaintiff failed to show constructive termination, here there is a contract that was agreed upon. Additionally, Collins is dealing with more than just trusted subordinates. Rather, Collins requires a team of chefs to prepare meals for these large groups, and it is industry standard for a head chef to control his assistant chefs. Additionally, Collins should argue lack of causation in responding to the breach of fiduciary duty claim. In Orkin, the plaintiffs could not show that defendant’s actions caused damage to the corporation. Similarly, Collins did no damage to the Marrimount because there were no statements made in competition with Marrimount. The only proof is Collins’s deposition, which states that he informed his old friend at a school reunion that he was leaving the Marrimount. There is no proof of a secret business arrangement with Treadwell and no proof that Collins desired to convince the Casketmakers Convention to relocate to the Treadwell. If Collins can show that business just followed his decision to leave, then there will not be a claim for a breach of fiduciary duty of loyalty. v. Likely outcome If the court finds that Crest did not breach the employment contract, then it will obviously find that Collins did breach by leaving the Marrimount. However, I believe it is unlikely that the court would find a breach of fiduciary duty of loyalty. There is simply too little evidence to survive a motion for summary judgment. While it is likely that the Casketmakers Convention changed venues to obtain Collins as the chef, it does not follow that Collins breached any fiduciary relationship. Remedies available to the parties a. Salary Collins would like to recover withheld salary that he earned from working in the kitchen prior to his termination. If Collins can show that he did not breach the contract or breach a fiduciary duty of loyalty, then he will obviously have no problems recovering his salary. Even if the court finds there was a breach of contract, Collins will still likely recover his salary, as the court in Prete v. Madison states, â€Å"It does not follow from the fact that a breach is material that the breacher can recover nothing for his performance. In an appropriate case, the courts have allowed a party who did not substantially perform to recover in restitution. † If, however, the court finds there was a breach of the fiduciary duty of loyalty, then Crest has a good argument to withhold earnings. In Orkin the court stated that one remedy for breach of this kind is â€Å"forfeiture of compensation by the employee during the period of breach of fiduciary duty. † Collins could still argue that he should get his salary from the period of time that he worked and was not yet in breach of his fiduciary duty. . Bonuses Whether or not Collins may recover his bonuses will be determined depending on if the court finds that Collins had a contractual entitlement to the percentage or a mere expectation. Crest will argue under Nadherny that Collins is not entitled to any bonuses after he left the kitchen, and possibly attempt to withhold bonuses from the time when he was working in the kitchen as well. It is my opinion that Coll ins would be better off not fighting for the bonuses after he left. Like many contracts, there was nothing clear in the language that dealt with a failed relationship and pursuing this claim could distract the court from focusing on salary and bonuses for time worked. Plus, it makes our client seem like he is fighting to be made whole, not just get something for nothing. IV. c. Restitution for increased salary Crest will argue under Lukaszewski that Collins will owe them the difference in salary that they will be forced to pay in order to procure a head chef to replace Collins. The court stated, â€Å"Thus damages for breach of an employment contract include the cost of obtaining other services equivalent to that promised but not performed, plus any foreseeable consequential damages. † In Lukaszewski the pay rates for teachers were set, and the school hired someone with more experience and the court still didn’t give the teacher any room to avoid paying for the increased expenses the school was faced with. It is likely that if the court finds that Collins breached his duty, he will be responsible for these damages. Collins can, however, argue that he does not owe as much as 25%. Collins’s salary was to be increased 12% each year. Thus, the additional 12% is money that the Marrimount was going to pay their head chef anyway and cannot be considered damages attributable to the breach. Additionally, Collins can argue that Crest cannot just go hire the most expensive chef and expect to recover the entire difference from Collins (Lukaszewski). d. Injunction or declaratory judgment The best way to get the declaratory judgment that Collins seeks is to get the court to rule in his favor that Crest breached the contract. If Crest breached the contract, then it cannot enjoin Collins from taking the job with Treadwell. In the unlikely event that the court does not find in favor of Collins, he still has options. Collins can point to the contract and show that there is nothing in there concerning any sort of provision not to compete. Therefore, Crest has no right to enjoin Collins from working where he chooses. V. Conclusion In conclusion, it seems likely that the court will find in favor of Collins on his breach of contract claim. Crest breached the contract by preventing Collins from hiring his own assistant chefs. Regardless of this, however, the court will likely find that Collins is owed salary for his time worked. There is no evidence sufficient to support a claim for breach of fiduciary duty and one cannot withhold salary from someone for a mere breach of contract. The issue of bonuses could go either way, but the argument is not that strong for either party. And finally, regardless of who breached the employment contract, it is likely that Collins will have not have trouble accepting the position of head chef at Treadwell, since there was no covenant to not compete.

Historical Book Analysis Assignment Essay

History, it has often been said, is as much a story of individual people as it is of places, events and larger circumstances. This is especially true when considering pivotal figures from American history, for in the stories of pivotal historical figures, the saga of the growth of America can often be seen. Such is the case with first lady, political activist and women’s rights pioneer Abigail Adams and former American slave, orator and anti-slavery advocate Frederick Douglass. It is with these two prominent historic figures in mind that two historical books about them, Dearest Friend: A Life of Abigail Adams and Narrative of the Life of Frederick Douglass, An American Slave will be discussed. Upon conclusion of the research, not only will two historical icons be better understood, but also, two key works about these people will be as well. Main Character of Each Work As was mentioned in the Introduction to this paper, two historical books as well as the people who were the main characters of those books would be discussed. Understanding the books first requires an understanding of the backgrounds of each of these main characters respectively. Abigail Adams, for all of the achievements that her life would hold, was not the product of fine universities or finishing schools; rather, she was for the most part an educated woman, and someone who possessed a great deal of inner drive and instinct, which more than made up for the lack of formal education. The wife of John Adams, who was a founding father of the United States and would eventually become president of the nation, Abigail managed the family farm, took care of the children, and showed a great streak of independence while John, early in his political career, was compelled to travel internationally. Abigail shared her husband’s passion for American independence, with one glaring exception- she did not subscribe to the idea that all men were created equal. For Abigail, there certainly was room to tolerate slavery, but this is not to say that Abigail felt the same about gender issues. One could fairly classify Abigail as a feminist, which she continued to advocate when she accompanied her husband to the White House. Overall, while not perfect, Abigail Adams contributed a great deal to the cause of women’s rights and by some accounts, aided her husband significantly during his presidency (Withey). Like Abigail Adams, Frederick Douglass was not the most formally educated man, but through sheer determination and a high level of natural intelligence, in time became one of the most articulate men in America, slave or free (Douglass). Early evidence of Douglass’ yearning for freedom and equality in a nation which promised this but only delivered to select races can be seen in his escape from slavery and refuge in northern free territory as a young man. This escape not only allowed him to pursue his own destiny, but also allowed him to seek the same for every man, with the abolition of slavery as Douglass’ main ambition. In fact, it was Douglass’ personal experience as a slave which gave him the credibility and passion that he required in order to be able to see the abolition of slavery to completion. Historical Events that Involved the Main Characters of Each Work When comparing Adams and Douglass, it can fairly be said that each of them were similarly exposed to extraordinary circumstances that inspired them to action, while being impaired to a certain extent by limitations that society attempted to place on them. In both cases as well, each of these individuals used that adversity not as a roadblock to future progress, but as a catapult to bigger and better things. Abigail Adams entered the stage of American history at a time when the role of the president as well as first lady was far from well defined, as well as a time when women were largely regarded as subordinates to their husbands and not worthy of equal opportunities or education. In the midst of all of these circumstances, Adams devoted a great deal of her energies in assisting her husband-some say too much- in the duties of the presidency and set the protocol for first ladies to come. Also, Adams chose as her cause the equality of women in all areas of society, making her an early pioneer for women’s equality. Like Adams, Frederick Douglass came upon the American scene at a time when pivotal issues were still undecided; for all of the talk of liberty and justice for all, Douglass had to flee from an environment whereby he was owned, like property, by another human being, as were tens of thousands of other African-Americans. Also, Douglass fearlessly spoke out against the evils of slavery, and became an influential resource for none other than Abraham Lincoln, who would become known in history as The Great Emancipator.

Environmental Protection Program

The collective action of humans – developing and paving over the landscape, clear-cutting forests, polluting rivers and streams, altering the atmosphere's protective ozone layer, and populating nearly every place imaginable – are bringing an end to the lives of creatures across the Earth. Extinction of biological species is not necessarily a phenomenon initiated by human activity, some argue. Although the specific role of extinction in the process of evolution is still being researched and debated, it is generally accepted that the demise of any biological species is inevitable. Opponents of special efforts to protect endangered species invariably point this out. They also suggest that the role of homo sapiens in causing extinction should not be distinguished from that of any other species. This position, most often espoused by individuals whose other views are curiously much more anthropocentric, is contrary to some well established facts. Unlike other creatures that have inhabited the Earth, human beings are the first to possess the technological ability to cause wholesale extermination of species, genera or even entire families of living creatures. This process is accelerating. Wildlife management efforts initiated during this century have been unsuccessful in stemming the tide. Most public attention given to endangered species has focused on mammals, birds, and a few varieties of trees. Ecologists recognize a far greater threat to the much larger number of species of reptiles, fish, invertebrates, and plants that are being wiped out by human activity. In the past few decades, vast areas in several regions of the world have been cleared to make room for urban development or for food production. Modern agriculture techniques and industries' need for raw material have contributed to the epidemic of extinction. During the last few centuries, growth in the human population and intensification of our use of resources has greatly increased the rate of species extinction. Today, this rate is at least 1,000 times higher than it was when the genus Homo made its appearance about 2 million years ago. According to the best estimates, an average of 200 species vanishes from the Earth every day. By the year 2025, an estimated 20 percent of Earth's species may have been pushed to extinction – a loss of species unmatched since the end of the Mesozoic 65 million years ago. For human beings, the consequences of this extensive wave of extinction's will be severe, whether they are viewed from a moral, aesthetic, scientific, or economic perspective. Scientists fear that the vitality of our ecology may be seriously threatened by the reduction of biological diversity resulting from the lost genetic resource contained in the extinct species. They note that the ability of species to evolve and adapt to environmental change depends on the existence of a vast pool of genetic material. This problem joins the issue of endangered species with that of wilderness preservation. Unfortunately, the need to set aside vast undeveloped areas to prevent wholesale extinction is more acute in the poorer, more crowded regions of the world where people are pressured by both their own basic needs and the demand of the industrialized world for their resources. The concept of biodiversity helps capture the magnitude of the problem. Biodiversity is the variety of, and interaction among, living organisms and the ecological complexes that they occur in, from the smallest habitat to the Earth as a whole. The concept also includes the genetic variability within these species, the raw material of both evolutionary adaptation and selective breeding by humans. In terms of biodiversity, extinction is more than the loss of individual species, it is the degradation of the ecological complexes that support all life on this planet. The set of plant, animal, fungus and microorganism species that occur together at a particular place make possible the functioning of an ecosystem at that place. Undisturbed ecosystems, with their natural level of biodiversity – regulate the flow of energy and the cycling of nutrients, which all life depends on. The ongoing elimination of a sizable portion of the Earth's biota is probably the clearest sign that the manner in which we use the natural environment is not sustainable. The intensity of our exploitation of natural resources is simply too great. In the past 40 years, human beings have wasted over a fifth of the Earth's topsoil, destroyed more than half of its forests, polluted most fresh and onshore marine waters, and profoundly changed the characteristics of the atmosphere. It is easy to put much of the blame on population growth. The human population has more than doubled over the past 40 years to reach the present level of more than 5. 5 billion. Each new person puts an added burden on the natural environment. Yet if we are to understand the roots of the problem and work towards real solutions, we need to look at other factors besides population growth. As living organisms, we must utilize the natural environment to satisfy our basic needs. The manner in which we do this, however, is as variable as human culture. The problem is that present social, economic, and political structures encourage us to maximize our use of natural resources rather than use them wisely. In today's world, economic resources are highly concentrated in industrialized countries, where most of the world's goods are consumed by a minority of the global population. Seventy-seven percent of the people in the world – most of whom live in less-developed nations – have only about 15 percent of the world's wealth, consume only 10 to 15 percent of the world's natural resources, and generate about 10 to 15 percent of the world's pollution. This global inequality is one of the major factors contributing to overuse of resources and destruction of natural habitats. At present, our ignorance of biodiversity is telling: scientists believe that the total number of species on Earth may be about 10 million, although only 1. million have been named and classified. Such knowledge is of great importance in itself, and of fundamental importance to achieving sustainable productivity. But it is only one of many prerequisites; another is a stable human population. Unfortunately – and only if we sustain our attention to family planning around the world – two to three times the current number of people may be alive when the human population levels out. At that point, the intelligent use of organisms and other natural resources will be absolutely essential for future stability. A stable human population, however, will not in itself allow us to attain a stable world. We must also address much more effectively the problems of poverty and lack of social justice throughout the world. This must include pursuing sustainable agricultural development in a way that guarantees more people access to the land they must have to meet their own needs. The role of women must also be enhanced throughout the world, in relation to health and family planning, literacy and school involvement, and participation in the work force. Another problem to confront is overconsumption of the world's resources by people in industrialized countries. Plans to preserve biodiversity and utilize it sustainably will fail as long as the global community continues to promote growth and consumption rather than reduce them. In addition, it is important to augment the number of educators, scientists, and engineers who live in developing countries, only about one in twenty of the world's scientists and engineers live there. Without technical knowledge and expertise, the chances for most less-developed nations to achieve sustainable productivity are poor. All nations must be given the opportunity to explore multiple paths, consistent with their own social values, for making biodiverisity an indispensable ingredient of socioeconomic, cultural, and scientific development. Without the achievement of a stable global population and the implementation of social justice, it simply will not be possible to learn about, manage, preserve, and benefit from what is left of the world's biodiversity. Understanding the connections between biodiversity, human institutions, and our long-term survival is the first step in learning to manage the biological resources of the planet Earth, our common home, for our mutual benefit. The sixth extinction is not inevitable. If humans are the cause, they can also be the solution. Conservation law in this country has taken a new turn, and in many ways California is leading the charge. The next decade will be an exciting and critical time for this state and the nation. The future of our natural resources and of our quality of life may well depend upon the choices and commitments we make over the next few years. If you travel the length or breadth of the state of California, you experience its diversity as a progression of distinct environments, each with characteristic plant species and climatic conditions. To highlight such contrasts, scientists have divided the state into large bioregions, each of which encompasses environments with broadly similar characteristics. A bioregion is itself a mosaic of unique aquatic and terrestrial environments-marshes, grasslands, woodlands, forests. California is composed of 11 major biogeographic areas, or bioregions. The great diversity of habitats within the state has allowed California to serve as a final refuge for species once dispersed throughout the West. The isolation provided by restricted habitats has allowed them to act not only as refuges, but also as centers of evolution for new species. Hence, California has a remarkably high degree of endemism – of species found nowhere else – in much the same way that an island often has endemic species. The two most important arbiters of California's natural landscapes are its Mediterranean climate and its varied topography. These factors are interconnected: landforms modify the climate, producing local variations in temperature and precipitation, and climate determines the nature and rate of erosion and soil deposition. Over eons, these and other factors have interacted to produce an amazing diversity of both landscapes and species. More than a third of the plants native to California are endemic, either evolving here in response to the continual opening up of new ecological niches, or finding refuge here after geologic change had altered their homelands. In California, population growth is obviously a direct cause of spreading urbanization. New housing developments and freeways overwhelm woods, meadows, and chaparral, destroying unique habitats full of evolutionary novelties, placing many native plant and wildlife species in imminent danger of extinction. It is tempting to blame our problems on overpopulation. The California that once supported 300,000 native Americans is now teeming with about 31. 5 million inhaitants-and their automobiles. It may be that the state's environment cannot support this many people, but we also should remember that incredible environmental damage had already been done when the state's human population numbered 1 million or fewer. It may be more appropriate to look at the nature of our economic system, a system oriented toward and dependent upon continuous growth, and one that operates on the fixed assumptions that there are potentially unlimited resources at one end of our economic pipeline and, at the other, a bottomless sink for disposal of wastes. Of course, there is neither. The first inhabitants of California lived for centuries within the limits of their environment, and the Spanish and Mexican economy was oriented more toward stability than growth. Unfortunately, the â€Å"get-rich-quick† mentality of the Gold Rush pioneers who followed them continues to play a role in California even now. The view of the natural world as a place to live, and therefore to care for, has not held its own against the view of nature as something to exploit. We have reached our present dilemma: Now we must balance the need to protect and maintain what is left of California's once renowned biodiversity against the need to care for the well-being of its human population. Yet protecting nature is no longer merely an option; the survival of humanity depends on the survival of our cohabitants on Earth.

Dark Tech: The Effect of the Cell Phone on Health

Today’s technologies are advancing at such an astonishing rate. This can make it difficult for even the most avid â€Å"techie† to keep pace. Technology is that wonderful thing that brings comfort and convenience to our lives. But, with that comfort and convenience, there often comes a price; and the technology of the cell phone proves no exception. Arguably, as a communication tool, the cell phone has no equal in how it has changed and affected our lives. Mostly, the effect has been positive in many ways. But, as it is with anything, overuse and abuse has brought out its dark side and the effect of unintended consequences.One of the unintended consequences of the cell phone is its effect on the health of its users and even the health of those around them. What is the effect of the cell phone on our health? Researchers are examining the health risks associated with cell phone use. This research has focused on traffic accidents, germs, cancer, electromagnetic radiation, and vision health. Traffic Accidents and Cell Phones Cell phone users knowingly, or unknowingly, put themselves and others in potentially hazardous situations by using a cell phone while driving.A recent study by the Centers for Disease Control and Prevention focused on cell phone distracted drivers in the United States. According to the study, sixty-nine percent of drivers in the United States, ages 18-64, reported that they had talked on their cell phone while driving within the last thirty days. Additionally, within that same demographic, thirty-one percent of U. S. drivers reported that they had read or sent text messages or email messages while driving at least once within the 30 days before they were surveyed.One must note that these percentages reflect only those drivers that â€Å"admitted† to the cell phone activity in question. Activities, such as texting, take the driver’s attention and hands away from driving more frequently and for longer periods than othe r distractions, making it proportionately more dangerous. Younger, inexperienced drivers under the age of 20 may be at a higher risk; they garner the highest proportion of distraction-related fatal crashes. The National Safety Council reports that at least 23 percent of all traffic crashes, or at least 1. 3 million crashes, involve cell phone use.This number can be broken down to an estimated 1. 2 million crashes each year involving drivers using cell phones for conversations and the remaining 100,000 or more additional crashes can be related to drivers who are texting. Analyzing this data shows that cell phone conversations are involved in 12 times as many crashes as texting. This seems to dispel the common myth that a texting driver is the more commonly dangerous cell phone activity. Additionally, and maybe surprisingly to some, it is not just our drivers causing dangerous situations on the roadways.Many times, pedestrians entranced with their cell phones are just as dangerous as drivers using them. A study published in Injury Prevention in 2012 reflects that one in three pedestrians is distracted by a mobile device while crossing busy streets. This type of distraction leads to accidents that injure both pedestrians and drivers. Germs and Cell Phones Cell phones not only carry important data, but nasty germs also. The greasy, oily residue you usually see on your cell phone after a week, or only a day, of use can often contain more disease-laden germs than those found on a toilet seat.In 2011, researchers from the London School of Hygiene & Tropical Medicine at Queen Mary, University of London found that one in six cell phones is contaminated with some sort of fecal matter. These fecal deposits find their way on to the handsets often because their owners did not wash their hands with soap and water after using the toilet. Some of the phones were found to harbor E. coli bacteria from fecal origin. If this bacterium is transferred into the mouth and ingested in to the body, it can cause fever, vomiting, and diarrhea.In another recent study, students in an Environmental Health course at South University, Columbia sought to find out what germs live on cell phones. After swabbing a sample of 60 phones belonging to students, they found that phones were frequently contaminated with methicillin-resistant Staphylococcus aureus (MRSA). According to Dr. Robert J. Wolff, PhD, program director of Health Science at South University, â€Å"Staph aureus is always dangerous and MRSA forms are worse because they cannot be stopped easily.†Staph skin infections, including MRSA, can quickly turn into deep, painful abscesses. The bacteria might remain confined to the skin, or burrow deeper into the body to cause potentially life-threatening infections in bones, joints, and surgical wounds. Once established in the body, the infection can infiltrate the bloodstream migrating to the heart valves and lungs tissues where it can wreak havoc on critical physi o-biological systems. Radiation and Cell Phone Usage Our cell phones certainly provide an efficient and easy way to communicate with friends, family, and co-workers.But, multiple research projects have suggested that excessive use of these communication devices may take a long-term toll on the user’s wellbeing. Cell phones use transmitting radio waves through a series of cell towers where radiofrequency (RF) waves create electromagnetic fields. Although cell phones are considered to be low-powered RF transmitters, your handset transmits power when it is on, and therefore it is important to increase your distance from the handset to reduce RF radiation exposure.The Federal Communications Commission (FCC) suggests cell phone users to keep a minimum distance of 20 centimeters from their handset to significantly reduce RF radiation exposure. Adults and especially children can suffer the long-term effects of radiation waves on the brain. According to Dr. Devra Davis, director for environmental oncology at the University of Pittsburgh, â€Å"Young children particularly need to be careful. We do not have enough information nor do we have enough time to be sure that cell phones are safe, and there's reason for concern that they may be harmful.†The University of Pittsburgh also warned its faculty and staff to limit their cell phone use due to the possible cancer risks. Vision and Cell Phones For those of you with smart phones, staring at your mobile device can cause problems in your vision later in life. Since screens on mobile devices tend to be smaller than computer screens, you are more likely to squint and strain your eyes while reading messages. According to the Vision Council, more than 70 percent of Americans don't know or are in denial that they are susceptible to digital eye strain.Additionally, smart phones and other hand-held devices are designed for reading at close range, so users’ eyes must constantly refocus and reposition to process the display’s text and graphics. As much as one-third of U. S. adults reported spending as many as four to six hours a day with their cell phones or related electronic devices. As digital device use increases, so do potential vision problems, including eye strain. Symptoms of this â€Å"digital† eye strain may include dry eyes, eye redness or irritation, blurred vision, neck and back pain, as well as headaches.Conclusion We know that today’s cell phone is the new wonder of modern technology that makes our lives richer and fuller as each new model is introduced. It is technically a microcomputer hidden beneath the cloak of a phone that puts the information super highway in our hip pocket for instant access at any time or place. Oh yeah, we can use it to communicate with our friends, family and co-workers too. So, are cell phones hazardous to our health? Well, if cell phones were handguns, they might be banned, or at the very least restricted by all means of laws and regulation.If cell phones were automobiles, an owner would probably need to take a safety course to get an operator’s license. To be serious, the cell phone is just a tool. If used in a safe manner and a little common sense, it is no more dangerous than any other tool (Said the three-fingered shop teacher). Unfortunately, not every cell phone user is endowed with common sense. So, until legislation catches up with the technology, the cell phone will have its dark side fraught with danger. Until then, to stay safe, we can clean our hands and cell phones regularly to keep the toilet germs and other assorted pathogens away from our mouths.We can keep our phone’s possible cancer causing RF at bay by using hands-free devices as much as possible. We can keep our eyesight a little longer by limiting device usage and eye strain. Last, but most importantly, we need to keep our cell phones in our pockets and purses while driving. If we need to make or answer a call, hand it to a passenger, pull over, or wait until we reach our destination to use the device. Just remember, when using your cell phone, think â€Å"safety first†; your health depends on it!

Pushing Paper Can Be Fun Essay

A large city government was putting on a number of seminars for managers of various departments throughout the city. At one of these sessions the topic discussed was motivation—how to motivate public servants to do a good job. The plight of a police captain became the central focus of the discussion: I’ve got a real problem with my officers. They come on the force as young, inexperienced rookies, and we send them out on the street, either in cars or on a beat. They seem to like the contact they have with the public, the action involved in crime prevention, and the apprehension of criminals. They also like helping people out at fires, accidents, and other emergencies. The problem occurs when they get back to the station. They hate to do the paperwork, and because they dislike it, the job is frequently put off or done inadequately. This lack of attention hurts us later on when we get to court. We need clear, factual reports. They must be highly detailed and unambiguous. As soon as one part of a report is shown to be inadequate or incorrect, the rest of the report is suspect. Poor reporting probably causes us to lose more cases than any other factor. I just don’t know how to motivate them to do a better job. We’re in a budget crunch, and I have absolutely no financial rewards at my disposal. In fact, we’ll probably have to lay some people off in the near future. It’s hard for me to make the job interesting and challenging because it isn’t- it’s boring, routine paperwork, and there isn’t much you can do about it. Finally, I can’t say to them that their promotions will hinge on the excellence of their paperwork. First of all, they know it’s not true. If their performance is adequate, most are more likely to get promoted just by staying on the force a certain number of years than for some specific outstanding act. Second, they were trained to do the job they do out in the streets, not to fill out forms. All through their careers the arrests and interventions are what get noticed. Some people have suggested a number of things, like using conviction records as a performance criterion. However, we know that’s not fair—too many other things are involved. Bad paperwork increases the chance that you lose in court, but good paper work doesn’t necessarily mean you’ll win. We tried setting up team competitions based on the excellence of the reports, but the officers caught on to that pretty quickly. No one was getting any type of reward for winning the competition, and they figured why they should bust a  gut when there was no payoff. I just don’t know what to do.
